Terms of Service

Welcome to Clear Cart ("the Service," "we," "us," "our"). By accessing or using the Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. What Clear Cart Is

Clear Cart is an informational tool that helps users identify whether grocery products in their possession may be subject to publicly available recall notices issued by the U.S. Food and Drug Administration (FDA) or U.S. Department of Agriculture Food Safety and Inspection Service (USDA FSIS), and surfaces ingredient information from public databases such as Open Food Facts.

Clear Cart is informational only. It is not medical advice, dietary advice, safety advice, or a substitute for direct verification with manufacturers or government agencies.

2. No Warranty of Accuracy or Completeness

The Service is in beta and may change, contain errors, or be unavailable at any time.

We make no representations or warranties of any kind, express or implied, about the accuracy, completeness, reliability, suitability, or availability of the information provided by the Service. Recall data, product data, ingredient data, and nutritional estimates are sourced from third parties (including but not limited to FDA, USDA, and Open Food Facts) and may be incomplete, outdated, missing, misidentified, or contain errors.

The Service may fail to identify a recalled product, may falsely indicate a recall, may miss ingredients that appear on a product label, or may return no information for products not present in source databases. You must independently verify recall status, ingredient information, and product safety with the manufacturer or relevant government agency before making any consumption or purchasing decisions.

3. Specific Limitations on Recall and Ingredient Matching

Recall matching may miss real recalls. Our matching relies on brand and product code data in public recall notices. Recalls may be missed when: brand spellings differ, product codes are formatted differently, recalls exist outside our currently synced dataset, source data is delayed or incomplete, or products are recalled under a parent company or private-label name that differs from the visible brand.

Ingredient matching is approximate. Ingredient flagging compares user-provided ingredient names against public product ingredient databases using approximate string matching. This process may fail to identify: ingredients listed under alternative names (for example, "sucrose" versus "sugar"), ingredients in languages other than English, ingredients within compound or derivative names, ingredients in "may contain" statements, or ingredients in products not present in the source database.

You must always read the actual product label before consuming any food. Do not rely on Clear Cart to identify any ingredient.

4. No Allergen, Medical, or Dietary Claims

Clear Cart does not provide any information, warning, or guidance about allergens, medical conditions, food safety, or whether a product is appropriate for any individual to consume. The "ingredients to avoid" feature reflects only user-defined preferences and is not a substitute for reading product labels and consulting healthcare professionals.

If you have a food sensitivity, intolerance, medical condition, or dietary restriction, you must independently verify all product information directly from the manufacturer's label and consult qualified healthcare professionals. Do not rely on the Service for any medical or health-related decision.

5. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent that you are at least 18 years of age.

6. Your Account

You are responsible for maintaining the confidentiality of any login credentials and for all activities under your account. We use passwordless ("magic link") authentication; you are responsible for protecting access to your email account.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Upload images that are not photos of your own grocery products or receipts
  • Upload images containing violent, sexual, illegal, or otherwise inappropriate content
  • Attempt to gain unauthorized access to the Service, other users' accounts, or our infrastructure
  • Reverse engineer, decompile, or attempt to derive source code from the Service
  • Submit malicious content or attempt to overwhelm the Service with automated requests
  • Resell, sublicense, or commercially redistribute information from the Service without our written permission
  • Misrepresent the Service's information to others (for example, publishing recall verdicts as authoritative)

8. Photo Submissions and Privacy

When you submit a photo for scanning, the image is sent to a third-party vision processing service (currently OpenAI) solely for the purpose of identifying products in the image. We do not store submitted images. Images are processed and discarded immediately. See our Privacy Policy for full details.

9. Intellectual Property

All rights, title, and interest in and to the Service (including software, design, and content other than third-party data) are and will remain our exclusive property. You may not copy, modify, or create derivative works of the Service without our prior written permission.

Third-party data displayed by the Service (recall information, product information, nutrition data) remains the property of its respective sources.

10. Third-Party Services

The Service relies on third-party APIs and data sources, including the openFDA API, USDA FSIS Recall API, Open Food Facts, OpenAI, Supabase, Vercel, and Resend. We are not responsible for the accuracy, availability, or actions of these third parties.

11. Limitation of Liability

To the maximum extent permitted by law:

  • The Service is provided "AS IS" and "AS AVAILABLE," without warranties of any kind
  • We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill
  • We are not liable for any harm — including illness, injury, or financial loss — resulting from reliance on information provided by the Service, or from the Service's failure to identify a recall, ingredient, or product hazard
  • Our total cumulative liability to you for any claim arising out of or relating to the Service is limited to the greater of (a) $50 USD or (b) the amount you paid us in the twelve months preceding the claim
  • Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability; in such jurisdictions, our liability is limited to the maximum extent permitted by law

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Service, (b) your violation of these Terms, or (c) your violation of any rights of a third party.

13. Termination

We may suspend or terminate your access to the Service at any time, for any reason, with or without notice. You may stop using the Service at any time. Provisions of these Terms that by their nature should survive termination (including limitation of liability, indemnification, and dispute resolution) will survive.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of New York, United States, without regard to its conflict of laws principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in New York County, New York, and you consent to the jurisdiction of those courts.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Clear Cart is an independent product not affiliated with the FDA, USDA, Open Food Facts, OpenAI, or any product manufacturer.
